DMCA Copyright Policy
In compliance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding copyright infringement. We reserve the right to:
-
Block access to or remove content that we reasonably believe infringes copyrighted material and has been unlawfully copied or distributed by any advertisers, affiliates, contributors, members, or users of our Services; and
-
Suspend or terminate Services to individuals who are repeat offenders.
Please note that your use of WoodNestly Services remains subject to our Terms of Service, which incorporate this Copyright Policy. Any terms not explicitly defined here shall have the meanings assigned to them in the Terms of Service.
Procedure for Submitting a Copyright Complaint
If you believe that material available on or through our Services infringes your copyright (or that of a party you are authorized to represent), please submit a written notification to our Designated Agent including the following details:
-
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
-
Identification of the copyrighted work claimed to have been infringed.
-
Identification of the material alleged to be infringing, with sufficient detail to allow us to locate it on our Services.
-
A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
-
Your full contact information (name, mailing address, telephone number, and email address, if available).
-
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Action Upon Receiving a Valid Notice
Once a proper copyright infringement notice has been received, we may:
-
Remove or disable access to the allegedly infringing material.
-
Notify the content provider accused of infringement.
-
Terminate access to our Services for repeat infringers.
Procedure for Filing a Counter-Notification
If you believe that the removed material (or disabled access) was the result of a mistake or misidentification, you may submit a counter-notice to our Designated Agent containing the following information:
-
Your physical or electronic signature.
-
Identification of the material that has been removed or disabled and the location where it appeared before removal.
-
A statement that you have a good-faith belief that the material was removed or disabled due to an error or misidentification.
-
Your full contact details (name, mailing address, telephone number, and email address).
-
A statement that you consent to the jurisdiction of the federal court in the district where your address is located, or, if outside the United States, to a judicial district in which WoodNestly operates, and that you will accept service of process from the original complaining party or their agent.
Upon receipt of a valid counter-notice, we may forward a copy to the original complainant. Unless the complainant files a court action seeking to restrain the alleged infringement, the removed material may be reinstated or access restored within 10–14 business days at our discretion.
